to be fair, this has always been the custom of the court. (they are self policing re. conflicts. there has also been controversy with Thomas not recusing himself from cases involving his wife's employer and there was a similar result: it is up to the individual justice.)
There IS a remedy to this that actually makes perfect constitutional sense: impeachment of the justice. That's what was threatened back in the '60s re. Abe Fortas. result: he resigned in disgrace rather than fight impeachment. Not that I think that will happen here.

I do not see where the Abe Fortas and Clarence Thomas issues had a real impact on society. If the Supremes rule in favor of Obamacare that ruling will have a huge impact on us as a society.
